Crew Members working in jurisdictions where paid sick and safe leave or paid leave is mandated will accrue and be permitted to use time for covered reasons based on the requirements of the law applicable to their location.
Acceptable Uses for Paid Sick Leave
Generally, you may use your accrued paid sick and safe leave if you will miss a scheduled work assignment for any acceptable use under the law applicable to your specific worksite location This generally includes:
Your medical needs – Illness, injury, or to receive medical care, treatment, diagnosis, or preventative care, such as doctor’s appointments, clinic and in-patient visits.
Your family member’s medical needs — To care for a family member who is ill, injured or receiving medical care, treatment, diagnosis or preventative care. Family members for this purpose include your child, parent, grandparent, sibling, domestic partner, or spouse.
Purposes related to domestic violence, sexual assault, or stalking suffered by you, with evidence of related court filing, such as protective orders or hearing notices.
Any additional reason covered under the law in your jurisdiction.
Note: Employees in Illinois, Nevada, Maine, Chicago, IL, and unincorporated areas of Bernalillo County, NM may use their accrued paid leave for any reason.
How to Use Paid Sick Leave
You should contact Bluecrew Support to request paid sick leave. Do not use the “cancel shift” function in the app. You should also notify the Client that you will be absent.
Notice should be provided prior to the shift’s start time. If the absence is foreseeable (e.g., a doctor’s appointment), reasonable advance notice may be required where your jurisdiction’s law allows. If the absence is not foreseeable, provide notice as soon as practicable.
To use paid sick leave, you must:
Be scheduled to work during the time you are requesting to use paid sick leave;
Contact Bluecrew Support; and
Be scheduled to work during the time you are requesting to use paid sick leave; and
Provide notice to the Client.
Most jurisdictions allow you to use sick leave once you have worked for your employer for 90 days. However, some jurisdictions have a different waiting period. Please see below for details.
Verification for Absences of Three or More Days
If you request to use paid sick leave for 3 or more consecutive work days, you may be required to provide verification, such as a doctor’s note, appointment receipt, or medical release. You are not required to provide details of the health condition, and any information you provide to Bluecrew will be kept confidential.
Payment of Sick Leave Benefits
Paid sick leave will be paid at the Crew Member’s regular rate of pay for the workweek in which leave is used, unless a different rate of pay is required by law. Paid sick leave is not considered “hours worked” for the purposes of calculating overtime.
No Cashing-out Unused Accrued Paid Sick Leave
Unused paid sick leave or paid leave balances are not "cashed out" or otherwise paid to Crew Members at the end of an assignment or upon termination of employment from Bluecrew, unless required by law.
Rehires and Restoration of Sick Leave Balances
If you terminate employment but return to working with Bluecrew within 13 months, your unused, accrued paid sick leave or paid leave balance may be reinstated to the extent required by applicable law.
State-Specific Paid Sick Leave Policies
Arizona:
Crew Members in Arizona earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 80 hours). There is a 90-day waiting period to use time in Arizona.
California:
Crew Members in California earn 1 hour of paid sick leave per 30 hours worked. You can earn up to 80 hours of paid sick leave per year and use up to 40 hours of paid sick leave per year. At the end of each year, all of your accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 80 hours). There is a 90-day waiting period to use time in California. Note that there are additional California cities that allow higher paid sick leave accrual and usage limits.
Colorado:
Crew Members in Colorado earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 48 hours of paid sick leave per year. At the end of each year, up to 48 hours of accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 96 hours). There is no waiting period to use accrued time in Colorado.
Washington, D.C.:
Crew Members in Washington, D.C. earn 1 hour of paid sick leave per 37 hours worked. You can earn and use up to 56 hours of paid sick leave per year. At the end of each year, all of your accrued, unused paid sick leave will roll over to the following year. There is a 90-day waiting period to use time in Washington, D.C.
Illinois:
Crew Members in Illinois earn 1 hour of paid leave per 40 hours worked. You can earn up to 40 hours of paid leave per year. At the end of each year, your accrued, unused paid leave will roll over to the following year, up to 40 hours. There is a 90-day waiting period to use time in Illinois.
Chicago, Illinois:
Crew Members in Chicago earn 1 hour of sick leave and 1 hour of paid leave for every 35 hours worked. You can earn up to 40 hours of sick leave per year and 40 hours of paid leave per year. At the end of each year, your accrued, unused paid sick leave will roll over to the following year, with an 80 hour carryover cap, to a maximum cap of 120 hours, and your unused paid leave will roll over to the following year, with 16 hour carryover cap, to a maximum of 56 hours. There is a 90-day waiting period to use time in Chicago. Sick leave and paid leave do not transfer to jurisdictions outside of Chicago.
Maryland:
Crew Members in Maryland earn 1 hour of paid sick leave per 30 hours worked. You can earn up to 40 hours and use up to 54 hours of paid sick leave per year. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year, to a maximum cap of 64 hours. There is a 106-day waiting period to use time in Maryland.
Massachusetts:
Crew Members in Massachusetts earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 40 hours). There is a 90-day waiting period to use time in Massachusetts.
Michigan:
Crew Members accrue 1 hour of earned sick time for every 30 hours worked in Michigan. You may use up to 72 hours of earned sick time each year. All accrued, unused time will be carried over to the following year at the end of the calendar year. There is a 120-day waiting period to use time in Michigan.
Minnesota:
Crew Members in Minnesota earn 1 hour of paid sick leave per 30 hours worked. You can earn up to 48 hours of paid sick leave per year. At the end of each year, all unused paid sick leave will roll over to the following year (for a maximum balance of 80 hours). There is no waiting period to use accrued time in Minnesota.
Nevada:
Crew Members in Nevada earn 0.01923 hours of paid leave per 1 hour worked. You can use up to 40 hours of paid leave per year. At the end of each year, up to 40 hours of accrued, unused paid leave will roll over to the following year. There is a 90-day waiting period to use time in Nevada.
New Jersey:
Crew Members in New Jersey earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 80 hours). There is a 120-day waiting period to use time in New Jersey.
New Mexico:
Crew Members in New Mexico earn 1 hour of paid sick leave per 30 hours worked. You can use up to 64 hours of paid sick leave per year. At the end of each year, up to 64 hours of accrued, unused paid sick leave will roll over to the following year. There is no waiting period to use accrued time in New Mexico.
New York:
Crew Members in New York earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 56 hours of paid sick leave per year. At the end of each year, all accrued, unused paid sick leave will roll over to the following year. There is no waiting period to use accrued time in New York.
Oregon:
Crew Members in Oregon earn 1 hour of paid sick leave per 30 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 80 hours). There is a 90-day waiting period to use time in Oregon.
Pennsylvania (Philadelphia, Pittsburgh, and Allegheny County):
Crew Members in Philadelphia, Pittsburgh, and Allegheny County earn 1 hour of paid sick leave per 35 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, all of your accrued, unused paid sick leave will roll over to the following year (for a maximum balance of 40 hours). There is a 90-day waiting period to use time in Philadelphia, Pittsburgh, and Allegheny County.
Rhode Island:
Crew Members in Rhode Island earn 1 hour of paid sick leave per 35 hours worked. You can earn and use up to 40 hours of paid sick leave per year. At the end of each year, all accrued, unused paid sick leave will roll over to the following year. There is a 90-day waiting period to use time in Rhode Island.
Washington:
Crew Members in Washington earn 1 hour of paid sick leave per 40 hours worked. There is no limit to how many hours of paid sick leave you can earn; you can use as much paid sick leave as you earn. At the end of each year, up to 40 hours of accrued, unused paid sick leave will roll over to the following year. There is a 90-day waiting period to use time in Washington.
